A class action is a type of lawsuit in which one or more people sue on behalf of a larger group of people. Often, one or a few people start a class action lawsuit by complaining about something.
In California, the process can be started by any possible plaintiff. The first thing to do is file a lawsuit and ask to be certified. The court then decides if the proposed new class action claim meets the requirements for certification. At this point, the judge doesn’t think about what the case is really about. The judge only decides if the claims should be brought to court under CCP 382.1.
The case becomes a lawsuit once the class is recognized. The court will send legal notice of the claim to anyone who might be involved in the case. This is usually done at the expense of the plaintiff. The notice will say what the case is about and each member’s rights.
Only if everyone in the class had the same harm done to them, most of the time, some people in the class have minor injuries, and others have major losses. So, when a class action is finally settled, the money should be split among the people in the class based on how much each person lost.
